INVITATION FOR PREQUALIFICATION FOR SURVEY, DESIGN AND

BUILD CONTRACTORS FOR COASTAL RAILWAY LINE IN THE NIGER DELTA REGION

10      INTRODUCTION

1.1     The Federal Government of Nigeria as part of Its post amnesty intervention and in furtherance of her commitment to the Infrastructural Development of the Niger Delta Region is desirous of constructing a Coastal Railway Line across the Niger Delta region.

1.2     The Federal Government of Nigeria  through the Federal Ministry of Transport now invites reputable national and international contractors/consultants with verification Documents for survey, Design and Build Contractors for the Proposed Coastal Railway Line in the Niger Delta Region.

2.0     PROJECT DESCRIPTION AND SCOPE OF WORKS

2.1     Coastal Railway Line

2.1.1  The proposed Coastal Railway Line is conceived as a standard gauge, high  speed railway line connecting the following State Capitals. Benin City Yenagoa – Port Harcourt – Uyo – Calabar and linking other important commercial towns such as Sapele, Warri, Ikot-Ekpene and Aba

2.1.2  The estimated total length of the railway line is about 420km with almost 20 stations located along the route of the project. For quick delivery, the government intends to split the project into two segments of 210km each.

2.1.3  The general scope of the project include.

  1. i.            Survey
  2. ii.            Design and
  3. iii.            Construction of a Modern Standard Railway Line Linking the six Niger Delta Region States of Edo, Delta, Bayelsa, Rivers, Abia, Akwa Ibom and Cross River.

3.0     APPLICATION PROCEDURE

3.1     The Procedure for awarding the Survey Design and Build Contract shall be conducted in two phases namely;

  • Invitation for pre-qualification of Contractors (with public opening) and
  • Submission of Proposals (Technical and Financial) by pre-qualified contractors (with Public opening)

4.       PARTICIPATION IN THE PREQUALIFICATION EXERCISE

4.1     Right to participate

4.1.2  All legal entities, domestic or foreign, independent or as a consortium, that are interested in the award of the Survey, Design and Construction Contracts, are eligible to participate in the Prequalification Exercise.

4-13 In the case of a consortium, one member of the consortium shall be appointed as the leading member and shall prove this authorization by submitting Power of Attorney letters signed by legally authorized representatives of the other members. Inclusion of Nigeria’s  Registered Engineering Consulting Firms in the consortium will be an added advantage.

4.1     Documentation Required

A.      Profile of firm/consortium

4.2.1 These should include ownership structure and role of each corporate entity with full contact details including email of the lead firm.

B.      Information on the financial and economic status of the firm:

  • Balance Sheet and Income Statement issued by an authorized body, i.e. an Audited Income Statement for the last three years for each member of the consortium. A requirement for Prequalification is that the leading member in the Consortium Submitting the Request must have a total annual turnover of at least N75bn ($500m) from activities relevant to Railway Construction, In each of the last three years.
  • Proof that each member of the consortium submitting the Request has paid all taxes and other state fees in accordance with the laws of the Country where it is registered and
  • Statement by a renowned (first rate) financial institution or bank concerning its intention to provide the Consortium with a credit line for the realization of the project.

C.      Information on Experience and Reference

Each member of the Consortium should have experience, individually or collectively, in protects similar to the Survey, Design and Construction of Railway Lines. Experience in construction of roads, highways and bridges are relevant.

D.      Information on the Management Structure and Operational Capabilities

  • Information on the proposed team to work on the project and information on the qualifications and experience of each team member;
  • Description of the organizational structure of the proposed team and how It Intends to operate;
  • Proof that each member of the consortium is a legal entity and that none of the legal entities or a member of their management have been convicted for corruption, fraud or money laundering by a court of law:
  • Information on the equipment/plan to be used on the project.

E.      Documentation and Information

  • Notarized certificate of the Registration documents for each member of the consortium;
  • An original or notarized copy of a contract. Memorandum of Understanding defining the relationship between the members of the consortium provided that the interested party is a consortium;
  • Proof that one member is appointed as the leading member, provided in a form of a Power of Attorney by each member of the consortium;
  • Statement by each member of the consortium confirming responsibility for the fulfillment of obligations resulting from the Survey/Design/Construction Contract to be awarded to that Consortium, they will be collectively and mutually liable for the obligations resulting from the contract,
  • Proof by the relevant state body that each member of the Consortium is not insolvent or involved in a bankruptcy proceedings and that it is not subject to a criminal investigation of its business activities.
  • Information on all past or ongoing judicial or administrative procedure against any member of the consortium.

5.0     LANGUAGE

5.1     The entire Documentation should be in English Language. Documents issued in another language should have notarized translation into English Language.

6.0     MANNER OF SUBMISSION

6.1 The Request for Prequalification and the associated documentation should be submitted in one (1) Original, five (5) hard copies and one (1) soft copy.

6.2 The Request for Prequalification and the associated documentation should be submitted in a doubly sealed envelope with an external and internal envelope.

6.3 The external envelope should bear the following text at the top left hand corner

REQUEST FOR SUBMISSION OF PREQUALIFICATION DOCUMENTS FOR SURVEY, DESIGN AND BUILD CONTRACTORS FOR THE COASTAL RAILWAY LINE IN THE NIGER DELTA REGION and addressed as stated in (7.2) below.

6.4 The internal envelope apart from the information above should contain the names and addresses of the interested party. Within the internal envelope, separate envelopes containing the appropriate number of copies marked “Original”, “Copy 1: “Copy 2”, “Copy 3”, “Copy 4”, and “Copy 5” should be submitted.

7.0     DEADLINE ANDADDRESS FOR SUBMISSION OF THE REQUEST

7.1 The Request for Prequalification for Survey, Design and Build Contractors for the Coastal Railway Line and the associated documentation should he submitted on or before 26th April 2010, at 16:00hrs local time.

7.2 The Request for Prequalification and the associated documentation are to be submitted at the following address:

7.3 Only Requests for Prequalification received within the deadline shall be taken into consideration. Any Request submitted after the expiration of the deadline, shall be rejected.

8.0     SELECTION

8.1 This being a Request for Prequalification, the opening and evaluation of the received Requests for Prequalification may be performed in the absence of the applicants

8.2 The Evaluation Committee constituted by the Honorable Minister of Transport shall determine the economic, financial strength of the interested parties that have submitted a Request for Prequalification and shall determine which of them are qualified to participate in the procedure for submission of Proposals.

8.3 The Pa-qualification shall be concluded within 21 days after the deadline for submission of the Request for Prequalification.

8.4 The Committee, following the Prequalification process shall notify, in writing all interested parties that participated in the procedure for prequalification concerning the results. The reason(s) for disqualification of each firm shall be given in a debriefing session before financial offers are received from prequalified bidders

8.5 Only the qualified candidate shall be invited to submit proposals (Technical and Financial)

9.0     OTHERS

9.1 This Invitation for Prequalification does not oblige in any way, the Federal Ministry of Transport to award the Survey, Design and Build Contract for the Construction of the Coastal Railway Line in the Niger Delta Region, to any particular contractor.

9.2 The Federal Ministry of Transport holds the right to change the terms for awarding the Survey, Design and Build Contract for the Coastal Railway Line in the Niger Delta Region as well as the deadlines for the procedures, in a manner and under conditions determined by it.

9.3 The Federal Ministry of Transport will not make any forms of payment or refund whatsoever for expenses incurred in response to this invitation

Pre-qualification are hereby invited from reputable contractors for the above road projects. For this reason the Ministry is inviting eligible Civil Engineering Contractors to be pre-qualified for the projects, Successful applicants shall meet the following minimum qualifying criteria for each projects,  as follows;

  1. i.            Annual turnover in construction works of at least N5,00.00 (for Construction Projects) and N1, 000,000,000,00 (for Rehabilitation Project) in the last three (3) years.
  2. ii.            Successful experience as a prime contractor on at least 1 project of a nature and complexity comparable to the works within the last three (3) years; and copies of letter/Certificates of to be attached; and
  3. iii.            Evidence that the Contractor has the requisite plant and equipment to execute a project of this nature and complexity comparable to these works.

3.         The pre-qualification document (2 copies) shall be signed, sealed in an envelope clearly marked “CONFIDENTILA” and bodly written “Prequalification for (Name of the Relevant Project)” and returned to:

Construction of Roads at FCDA

INVITATION FOR PRE-QUALIFICATION TO TENDER FOR THE FOLLOWING PROJECTS

The Federal Capital Development Authority (FCDA) through the Department of Satellite Town Infrastructure intends to procure the under listed projects within the year 20 1 0 budget.

In line with the 2007 Public/Procurement Act. the Authority is inviting interested, competent and reputable Engineering Construction Companies to submit pre-qualification documents for any of the under listed projects:.

  1. PROVISION OF 13KM ROAD FROM KUJE TO GAUBE
  2. CONSTRUCTION OF BWARI KAWU ROAD
  3. CONSTRUCTION OF ONEX BWARI ROAD

2.       SCOPE OF WORK

The scope of work includes the following:

(i)                Site clearance and earthworks

(ii)             Construction of concrete lined draineds

(iii)           reinforced concrete box culverts,

(iv)           pre-cast concrete pipe culverts.

(v)             Stone pitching.

(vi)           Construction of road pavement consisting of laterite sub-base Crushed stone base (wet process )

(vii)        Laying of asphaltic concrete finishing

(viii)      Scarification of existing bituminous surface dressing asphalt (For project 2 only)

3.       PRE-QUALIFICATION REQUIREMENTS

Interested Companies are invited to submit the following Pre-qualification documents:

3.1     CONTENT OF TECHNICAL PROPOSAL

1)    Evidence of incorporation of the Company with Corporate Affairs commission (CAC) including Articles and Memorandum of Association of the company and up to date Annual return with the CAC (mention forms C02 & 07 to be included).

2)    The Company must show evidence of fulfilling of its Tax obligations as follows:

(i)                Tax Clearance Certificate for the last three(3) years supplied with TIN

(ii)             Pension and Social Security Contributions

3)    A sworn Affidavit certifying as follows:

(i)                The company is not in receivership, insolvency or bankruptcy

(ii)             The Company does not have any directors who has been convicted By any court in Nigeria and any other country for criminal offence in relation to fraud or Financial impropriety

(iii)           That no Officer of FCDA or B PP is a former or present director or shareholder of the company

(iv)           That there has been no promise of a gift in any form to any of the FCDA or BPP Staff.

(4)     Audited Accounts of the Bidder for the last three endorsed by a firm of Chartered Accountants

(5)     Letter authorizing FCDA and her representatives to cross-check the submitted company’s Bank account.

(6)     Evidence of work experience as the main contractor executing or having executed a minimum of five (5) projects of similar complexity compared to the proposed work, one of which must have been within the last 5 years. Copies of Award Letters. Last Interim Certificate of Valuation for on-going projects. Completion Certificates and Final Maintenance Certificates where applicable are to be enclosed.

(7)     Verifiable list of major construction equipment and facilities including registration numbers, chassis numbers, location (where the they can be inspected) and remark on whether these are owned, leased or hired. The minimum number of equipment facilities required are as listed below:

a)     Two (2) Nos Bulldozers

b)    Three (3) Nos Scrappers

c)     Two (2) Nos Graders

d)    Two (2) Nos Excavators

e)     Four (4) Nos Pay Loaders

f)      Two (2) Nos Water Tankers

g)     One (1) Nos Diesel Tanker

h)    Two (2) Nos Mobile Concrete Mixers

3.       PRE-QUALIFICATION REQUIREMENTS

Interested Companies are invited to submit the following pre-qualification documents

(9)     The company must not cause changes to any substance in a bid.

(10)   Evidence of work experience as the main contractor executed A minimum of five (5) project of similar of similar complexity compared to the proposed work, one of which must have been within the last 5 years Copies of Award Letters, Last Interim Certificate of valuation for on-going projects Completion Certificates and Final Maintenance Certificates where applicable are to the enclosed.

(11)   Veritable list of major construction equipment and facilities including registration numbers chassis numbers, location (where they can be inspected) and remark on whether these are owned leased or hired

(12)   A functional and well equipped material testing laboratory for projects 2&3

(13)   List of key technical personnel stating their roles designation, qualifications and years of experience with the guarantee that a minimum of ten (10) relevant COREN Registered Engineers of various disciplines shall be deployed to the project. Copies of educational and professional certificate are to be attached.

(14)   History of company’s policy on Community Social responsibility

Payment of Advance is a privilege and a right. Delays in/or payment of such Advance(s) should not be used as an excuse to delay commencement/ performance of works.

The photocopies of professional certificates arc to be initialled, endorsed by the owners and professional seal must be embossed on the professional certificates.

You may wish to report to Capital Procurement Division, Procurement Department, Room 005 (Ground Floor) New FCDA Headquarters opposite NTA Abuja, Area 11, Garki, Abuja to collect tender documents on the presentation of payment of non-refundable Tender Fee of N20, 000.00 (Two Thousand Naira) only for Projects Two (2) of Aso Savings and Loans Limited. Area 11, Garki Abuja in favour of the Federal Capital Development Authority. Tender documents may be collected as from 1st March. 2010 between the hours of 8:00a.m. to 4:00p.m. daily.

5.0     SUBMISSION OF DOCUMEN TS

The bid documents must be in a sealed envelope and clearly marked TENDER (INDICATE PROJECT OF CHOICE LOT AND SERIAL NUMBER). Technical proposals should be enveloped differently from Financial bids. Part A which is Technical shall be submitted in a sealed envelope and clearly marked “TECHNICAL” while Part B shall consist of the Financial bid which shall be similarly marked “FINANCIAL” submitted along with a set of photocopies and all enclosed in one envelop. The completed Technical/Financial tender should be submitted in a sealed envelope to Room 0.005. Office of the Deputy Director, Capital Procurement Division, Procurement Department, Ground Floor, FCDA New Secretariat. Area 11, Garki, Abuja on or before 12.00 noon Wednesday 7th April, 2010.. (v)                Embankment protection involving stone pitching, grassing and placement of boulders at the embankment toes (Apply to 5 and 6 only).

(vi)              Construction of road pavement consisting of laterite sub-base, crushed stone base (wet process)

(vii)           Laying of asphaltic concrete finishing

(viii)         Water Supply (Applies to project 4 alone)

3.       PRE-QUALIFICATION REQUIREMENTS

Interested Companies are invited to submit the following pre-qualification documents

3.1        CONTENT OF TECHN1CAL PROPOSAL-

1)    Evidence of incorporation of the Company with Corporate Affairs Commission (CAC) including Articles and Memorandum of Association of the company and up to date Annual return with the CAC (mention forms C 02 & 07 to be including)

2)    The Company must show evidence of fulfilling of its Tax Obligations as follows

(i)  Tax Clearance Certificate for the last three (3) years supplied with TIN

(ii) Pension and Social Security Contributions

3)    A sworn Affidavit certifying as follows;

(i)                The company is not in receivership, it

(ii)             The Company does not have any directors who has been convicted by any court in Nigeria and any other country for criminal offence in relation to fraud or Financial impropriety

(iii)           That no Officer of FCDA or BPP is a former or present director or shareholder of the company

(iv)           That there has been no promise of a gift in any form to any of the Staff.

(4)     Audited Accounts of the Bidder for the last three (3) years duly endorsed by a firm of Chartered Accountants

(5)    Letter authorizing FCDA and her representatives to cross-check the submitted company’s Bank account.

(6)     Evidence of work experience as the main contractor executing or having executed minimum of five (5) projects of similar complexity compared to the proposed work, one of which must have been within the last 5 years Copies of Award Letters Last Interim Certificate of Valuation for on-going projects. Completion Certificates and Final Maintenance Certificates where applicable are to be enclosed.

(7)     Verifiable list of major construction equipment and facilities including registration numbers, chassis numbers, location (where the they can be inspected) and remark on whether these are owned, leased or hired. The minimum number of equipment facilities required are as listed below:

a)     Two (2) Nos Bulldozers

b)    Three (3) Nos Scrappers

c)     Two (2) Nos Graders

d)    Two (2) Nos Excavators

e)     Four (4) Nos Pay Loaders

f)      Two (2) Nos Water Tankers

g)     One (1) Nos Diesel Tanker

h)    Two (2) Nos Mobile Concrete Mixers

i)       Three (3) Nos various Compactors

j)       Five (5) Nos 20 30 ton tippers

k)    Five (5) Nos Dumpers

(8)     A functional and well equipped material testing laboratory.

(9)     List of key technical personnel stating their roles, designation, qualifications and years of experience with the guarantee that a minimum of ten (10) relevant COREN Registered Engineers of various disciplines shall be deployed to the project Copies of educational and professional certificates are to be attached.

(10)   History of company’s policy on Community Social responsibility

NOTES:

Items I 5 are Eligibility Requirements and their Originals must be produced by the company for sighting during the opening session.

All claims must be substantiated with verifiable facts.

The photocopies of professional certificates are to be initialed, endorsed by the owners and professional seal must be embossed on the professional certificates.

40      SUBMISSION OF DOCUMENTS:

The pre-qualification documents should be submitted directly to FCDA Procurement Department. Room 005 (Ground Floor) New FCDA Headquarters opposite NTA Abuja, Area 11, Garki Abuja on or before 12 noon, Wednesday 7th April, 2010. All documents will be publicly opened on the same day at the FCDA Conference Room after the close of bids in the presence of all prospective bidders or their Representatives.

Further Notes:

  1. Only companies with a minimum of N1 billion (One Billion Naira) annual turnover need apply
  2. This is not an invitation to lender. Only pre-qualified firms will he invited to tender for the project. Others may know their performance by a formal request to the Accounting Officer of FCDA.
  3. Interested companies are responsible for the registration, timely and safe submission of their pre-qualification documents, means of delivery notwithstanding
  4. The Authority shall carry out Due Diligence on the companies to verify claims included in their submissions.
  5. 5. Interested members of the Public especially Civil Rights organizations could attend at their own cost and will be required to introduce themselves to the chairman of the opening session.
  6. Companies should not express interest in more than 2 projects.
