INVITATION FOR PREQUALIFICATION FOR SURVEY, DESIGN AND
BUILD CONTRACTORS FOR COASTAL RAILWAY LINE IN THE NIGER DELTA REGION
10 INTRODUCTION
1.1 The Federal Government of Nigeria as part of Its post amnesty intervention and in furtherance of her commitment to the Infrastructural Development of the Niger Delta Region is desirous of constructing a Coastal Railway Line across the Niger Delta region.
1.2 The Federal Government of Nigeria through the Federal Ministry of Transport now invites reputable national and international contractors/consultants with verification Documents for survey, Design and Build Contractors for the Proposed Coastal Railway Line in the Niger Delta Region.
2.0 PROJECT DESCRIPTION AND SCOPE OF WORKS
2.1 Coastal Railway Line
2.1.1 The proposed Coastal Railway Line is conceived as a standard gauge, high speed railway line connecting the following State Capitals. Benin City Yenagoa – Port Harcourt – Uyo – Calabar and linking other important commercial towns such as Sapele, Warri, Ikot-Ekpene and Aba
2.1.2 The estimated total length of the railway line is about 420km with almost 20 stations located along the route of the project. For quick delivery, the government intends to split the project into two segments of 210km each.
2.1.3 The general scope of the project include.
- i. Survey
- ii. Design and
- iii. Construction of a Modern Standard Railway Line Linking the six Niger Delta Region States of Edo, Delta, Bayelsa, Rivers, Abia, Akwa Ibom and Cross River.
3.0 APPLICATION PROCEDURE
3.1 The Procedure for awarding the Survey Design and Build Contract shall be conducted in two phases namely;
- Invitation for pre-qualification of Contractors (with public opening) and
- Submission of Proposals (Technical and Financial) by pre-qualified contractors (with Public opening)
4. PARTICIPATION IN THE PREQUALIFICATION EXERCISE
4.1 Right to participate
4.1.2 All legal entities, domestic or foreign, independent or as a consortium, that are interested in the award of the Survey, Design and Construction Contracts, are eligible to participate in the Prequalification Exercise.
4-13 In the case of a consortium, one member of the consortium shall be appointed as the leading member and shall prove this authorization by submitting Power of Attorney letters signed by legally authorized representatives of the other members. Inclusion of Nigeria’s Registered Engineering Consulting Firms in the consortium will be an added advantage.
4.1 Documentation Required
A. Profile of firm/consortium
4.2.1 These should include ownership structure and role of each corporate entity with full contact details including email of the lead firm.
B. Information on the financial and economic status of the firm:
- Balance Sheet and Income Statement issued by an authorized body, i.e. an Audited Income Statement for the last three years for each member of the consortium. A requirement for Prequalification is that the leading member in the Consortium Submitting the Request must have a total annual turnover of at least N75bn ($500m) from activities relevant to Railway Construction, In each of the last three years.
- Proof that each member of the consortium submitting the Request has paid all taxes and other state fees in accordance with the laws of the Country where it is registered and
- Statement by a renowned (first rate) financial institution or bank concerning its intention to provide the Consortium with a credit line for the realization of the project.
C. Information on Experience and Reference
Each member of the Consortium should have experience, individually or collectively, in protects similar to the Survey, Design and Construction of Railway Lines. Experience in construction of roads, highways and bridges are relevant.
D. Information on the Management Structure and Operational Capabilities
- Information on the proposed team to work on the project and information on the qualifications and experience of each team member;
- Description of the organizational structure of the proposed team and how It Intends to operate;
- Proof that each member of the consortium is a legal entity and that none of the legal entities or a member of their management have been convicted for corruption, fraud or money laundering by a court of law:
- Information on the equipment/plan to be used on the project.
E. Documentation and Information
- Notarized certificate of the Registration documents for each member of the consortium;
- An original or notarized copy of a contract. Memorandum of Understanding defining the relationship between the members of the consortium provided that the interested party is a consortium;
- Proof that one member is appointed as the leading member, provided in a form of a Power of Attorney by each member of the consortium;
- Statement by each member of the consortium confirming responsibility for the fulfillment of obligations resulting from the Survey/Design/Construction Contract to be awarded to that Consortium, they will be collectively and mutually liable for the obligations resulting from the contract,
- Proof by the relevant state body that each member of the Consortium is not insolvent or involved in a bankruptcy proceedings and that it is not subject to a criminal investigation of its business activities.
- Information on all past or ongoing judicial or administrative procedure against any member of the consortium.
5.0 LANGUAGE
5.1 The entire Documentation should be in English Language. Documents issued in another language should have notarized translation into English Language.
6.0 MANNER OF SUBMISSION
6.1 The Request for Prequalification and the associated documentation should be submitted in one (1) Original, five (5) hard copies and one (1) soft copy.
6.2 The Request for Prequalification and the associated documentation should be submitted in a doubly sealed envelope with an external and internal envelope.
6.3 The external envelope should bear the following text at the top left hand corner

REQUEST FOR SUBMISSION OF PREQUALIFICATION DOCUMENTS FOR SURVEY, DESIGN AND BUILD CONTRACTORS FOR THE COASTAL RAILWAY LINE IN THE NIGER DELTA REGION and addressed as stated in (7.2) below.
6.4 The internal envelope apart from the information above should contain the names and addresses of the interested party. Within the internal envelope, separate envelopes containing the appropriate number of copies marked “Original”, “Copy 1: “Copy 2”, “Copy 3”, “Copy 4”, and “Copy 5” should be submitted.
7.0 DEADLINE ANDADDRESS FOR SUBMISSION OF THE REQUEST
7.1 The Request for Prequalification for Survey, Design and Build Contractors for the Coastal Railway Line and the associated documentation should he submitted on or before 26th April 2010, at 16:00hrs local time.
7.2 The Request for Prequalification and the associated documentation are to be submitted at the following address:

7.3 Only Requests for Prequalification received within the deadline shall be taken into consideration. Any Request submitted after the expiration of the deadline, shall be rejected.
8.0 SELECTION
8.1 This being a Request for Prequalification, the opening and evaluation of the received Requests for Prequalification may be performed in the absence of the applicants
8.2 The Evaluation Committee constituted by the Honorable Minister of Transport shall determine the economic, financial strength of the interested parties that have submitted a Request for Prequalification and shall determine which of them are qualified to participate in the procedure for submission of Proposals.
8.3 The Pa-qualification shall be concluded within 21 days after the deadline for submission of the Request for Prequalification.
8.4 The Committee, following the Prequalification process shall notify, in writing all interested parties that participated in the procedure for prequalification concerning the results. The reason(s) for disqualification of each firm shall be given in a debriefing session before financial offers are received from prequalified bidders
8.5 Only the qualified candidate shall be invited to submit proposals (Technical and Financial)
9.0 OTHERS
9.1 This Invitation for Prequalification does not oblige in any way, the Federal Ministry of Transport to award the Survey, Design and Build Contract for the Construction of the Coastal Railway Line in the Niger Delta Region, to any particular contractor.
9.2 The Federal Ministry of Transport holds the right to change the terms for awarding the Survey, Design and Build Contract for the Coastal Railway Line in the Niger Delta Region as well as the deadlines for the procedures, in a manner and under conditions determined by it.
9.3 The Federal Ministry of Transport will not make any forms of payment or refund whatsoever for expenses incurred in response to this invitation
